These Terms of Service (“Terms”) govern your use of BetterSured, a service operated by Goldfish Context Co d/b/a BetterSured (“BetterSured,” “we,” “us,” or “our”). By using BetterSured, you agree to these Terms. If you do not agree, please do not use BetterSured.
1. Eligibility
You must be at least 18 years old and a resident of the United States to use BetterSured. By using BetterSured, you represent that you meet these requirements.
2. What BetterSured Does
BetterSured helps consumers organize insurance information and request insurance quotes from independent insurance agents and brokers.
You may provide us with information about your home, vehicles, drivers, current insurance policies, coverage preferences, claims, and other details relevant to shopping for insurance.
We use this information to prepare a quote-request package and share it with insurance agents and brokers who may contact you to provide quotes or related insurance services.
3. We Are Not an Insurance Agent, Broker, or Advisor
Unless expressly stated otherwise, BetterSured is not an insurance carrier, insurance agency, insurance broker, producer, underwriter, or financial advisor, and we are not licensed as an insurance producer in any state.
We do not sell, bind, underwrite, negotiate, solicit, or issue insurance policies, and we cannot sell you insurance. We do not guarantee that you will receive a quote, receive a lower price, obtain better coverage, or be approved for insurance.
Any quote, recommendation, coverage advice, application, bind request, or policy decision is handled solely by the licensed agent, broker, or insurance company. Our services and the availability of partners may vary by state.
4. How We Are Paid
BetterSured is free for consumers. We are compensated by insurance agents, brokers, and agencies — for example, they may pay us a fee for the introductions or leads we provide to them. We may be paid whether or not you purchase a policy.
This means we have a financial incentive to connect you with partners who compensate us. You are never obligated to request, accept, or purchase insurance from anyone we introduce you to, and you remain free to shop for insurance however you choose.
5. Permission to Share Your Information
By submitting your information through BetterSured, you authorize us to share it with insurance agents, brokers, agencies, carriers, service providers, and related partners for the purpose of helping you shop for insurance.
This information may include:
- Your name and contact information;
- Home, vehicle, driver, and household details;
- Current insurance policy information;
- Desired coverage levels;
- Uploaded documents;
- Claims or loss-history information you provide;
- Quote preferences; and
- A BetterSured-generated summary or fact sheet.
You understand that agents or brokers may contact you by phone, text message, email, or other methods using the information you provide.
6. Contact From Partner Agents and Brokers
When you submit a quote request, you consent to be contacted by BetterSured and by the agents and brokers we share your information with, regarding your insurance quote request.
If you provide your phone number to a partner agent or broker, or ask a partner to contact you, then any calls, text messages, or other communications between you and that partner are part of your direct relationship with that partner and are governed by that partner’s own communication practices, consents, and legal obligations. BetterSured does not control, and is not responsible for, how partners contact you.
You may opt out of BetterSured’s own marketing communications at any time. To stop contact from a particular agent or broker, please contact that partner directly.
7. Sensitive Information
Some information that helps produce accurate quotes is sensitive — for example, date of birth, driver’s license number, and claims or loss-history details.
Providing this information to BetterSured is optional. However, most agents and brokers will require it to prepare firm quotes or to bind coverage, and they may request it from you directly. Where you provide sensitive identifiers to us, we encrypt them and share them only with the agents and brokers you authorize. See our Privacy Policy for details on how we handle, retain, and delete your information.
8. Use of AI
BetterSured uses artificial intelligence and automated tools to read, summarize, classify, compare, and assess the insurance documents and information you provide. AI may be used to create summaries, coverage fact sheets, quote-request packets, coverage comparisons, and broker-facing materials.
We use a third-party AI service provider (currently Anthropic) to process this content. Your information and documents are not used to train AI models, are not retained by our AI provider beyond the limited period required to provide the service (in accordance with the provider’s data-retention terms), and are not shared for any other purpose.
AI-generated outputs may contain errors, omissions, or outdated interpretations. You should review important information for accuracy. Licensed agents, brokers, and carriers are responsible for final quotes, policy terms, coverage advice, and binding decisions.
9. Email and Document Delivery
You understand and agree that BetterSured may create PDF summaries or fact sheets containing your insurance information and deliver them to agents, brokers, or other authorized recipients, including by email.
We use commercially reasonable and, where practical, secured methods to protect your information. However, no method of electronic transmission is completely secure, and we cannot guarantee that email transmission will be error-free, encrypted end-to-end, or immune from unauthorized access. Please do not submit information you are not comfortable having shared for insurance quote purposes.
10. Your Responsibilities
You agree that the information you provide will be accurate, current, and complete to the best of your knowledge.
You are responsible for reviewing all quotes, applications, coverage terms, exclusions, deductibles, limits, and policy documents before purchasing insurance. You should not rely on BetterSured as your sole source of insurance, legal, financial, or risk-management advice.
11. No Guarantee of Savings or Coverage
BetterSured may help identify quote opportunities, coverage gaps, or potential savings, but we do not guarantee:
- Lower premiums;
- Better coverage;
- Quote availability;
- Policy issuance;
- Carrier acceptance;
- Accuracy of agent or broker quotes; or
- That any policy will meet your needs.
12. Partner Agents and Brokers
Agents and brokers who receive your information are independent third parties. They are not employees or representatives of BetterSured unless expressly stated.
BetterSured is not responsible for their advice, quotes, communications, services, errors, omissions, or policy recommendations.
13. Privacy
Our collection, use, storage, and sharing of personal information is described in our Privacy Policy. By using BetterSured, you also agree to our Privacy Policy.
14. Deleting Your Data and Withdrawing Consent
You may withdraw your consent to future sharing, ask us to stop contacting you, or request deletion of the information we hold about you at any time by emailing privacy@bettersured.com. We handle these requests as described in our Privacy Policy.
Please note that we cannot recall information already shared with an agent or broker before your request, and those partners maintain their own records under their own policies.
15. Limitation of Liability
To the fullest extent permitted by law, BetterSured is not liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost savings, lost coverage, premium increases, claim denials, or damages resulting from third-party agent, broker, or carrier actions.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of BetterSured will be resolved by binding individual arbitration administered in the State of Minnesota, rather than in court, except that either party may bring an individual claim in small-claims court where eligible.
To the fullest extent permitted by law, you and BetterSured each waive the right to a jury trial and agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative action.
17. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted with a new “Last updated” date. Continued use of BetterSured after changes means you accept the updated Terms.
